1. Acceptance of Terms

By downloading, installing, or using Steppers ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

2. Privacy Policy

Our Privacy Policy describes how we collect, use, and protect your personal data. The Privacy Policy is incorporated into and forms part of these Terms. By agreeing to these Terms, you also agree to the Privacy Policy.

3. Description of Service

Steppers is a social fitness app that lets you track your daily steps and compete with friends and family in teams. Features include step tracking, team leaderboards, weekly contests, and AI-generated character creation.

4. Eligibility

You must be at least 13 years old (or at least 16 in jurisdictions where GDPR or local law sets a higher age of digital consent) to use Steppers. By using the app, you represent that you meet this age requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

5. User Accounts

To use Steppers, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information during registration and to keep it up to date.

6. Character Generation & Intellectual Property

Steppers allows you to generate a personalized in-app character using our AI-powered character creation system. By using this feature, you acknowledge and agree to the following:

6.1 Ownership of Art Assets

All artwork, visual styles, templates, and technology used to generate characters are and remain the exclusive property of Steppers. This includes, but is not limited to, art styles, rendering pipelines, and any visual elements that make up the character generation system.

6.2 Your License to Use Your Character

We grant you a personal, non-exclusive, non-transferable, revocable license to use your generated character within the app and to share screenshots or images of your character on social media and messaging platforms for personal, non-commercial purposes.

6.3 Our License to Use Your Character

By generating a character, you grant Steppers a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, modify, display, and distribute your generated character for the purposes of operating and improving the app. This includes, for example, displaying your character in team leaderboards, contest screens, and other in-app features. We will not use your character in marketing or promotional materials without your separate consent.

6.4 Restrictions

You may not:

• Use your generated character for any commercial purpose, including but not limited to selling merchandise, prints, or digital assets featuring the character.
• Claim ownership or seek intellectual property registration (such as trademark or copyright) over any generated character.
• Use the character generation system to create content that is illegal, hateful, sexually explicit, promotes violence or harm, or violates the rights of others.

6.5 Photos Used for Generation

If you upload a photo to generate your character, you represent that you have the right to use that photo. The photo is used solely for the purpose of generating your character and is handled in accordance with our Privacy Policy.

7. User Conduct

You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable laws.
• Attempt to interfere with, disrupt, or gain unauthorized access to the app or its systems.
• Impersonate another person or misrepresent your identity.
• Use automated systems, bots, or scripts to interact with the app or manipulate step counts.
• Harass, abuse, or harm other users.

8. Health Data

By connecting Apple HealthKit (iOS) or Health Connect (Android), you consent to our collection and use of your step count data as described in our Privacy Policy. Step data is used solely to power app features such as leaderboards and contests. We do not sell your health data or use it for advertising.

9. In-App Purchases

Steppers may offer in-app purchases. All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms. Refunds are handled by the applicable store provider.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to other users or the app. You may delete your account at any time through the in-app settings.

11. Disclaimer of Warranties

Steppers is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. Your use of the app is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Steppers and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to loss of data, loss of profits, or personal injury.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the app after changes are posted constitutes acceptance of the revised Terms.
